My loan agreement is with Somo. It is an unsecured loan with the benefit of a trust arrangement, which holds the legal mortgages secured over the property with the borrower on behalf of me as a beneficiary. If Somo were to stop trading or become insolvent, then these security interests are ring fenced from the Somo insolvency. The liquidator or administrator should be obliged to recognise the trust arrangements and use the property in trust to return capital and interest to the relevant Lenders (and not apply these assets towards Somo’s creditors generally).

My loan agreement is directly with the borrower, and as a result, I have a direct contractual relationship with the borrower. I own part of the legal mortgage used a security. In the event of Somo’s insolvency, I would be able to pursue the borrower directly.
